SUMMARY:ABA Annual Dispute Resolution Conference | Exercising Opportunities for Control in Technology Arbitrations
DESCRIPTION:A program with four experienced and diverse arbitrators\, all of whom are members of the Silicon Valley Arbitration & Mediation Center’s (SVAMC) 2021 Tech List will participate in a panel during the ABA’s Annual Dispute Resolution Conference. They will present and discuss techniques and new methods for making arbitrations involving science\, technology and underlying intellectual property more effective\, practical and efficient for the parties. A key goal of the business lawyer is to help clients identify and manage risks associated with the deal\, particularly those with the highest probability of occurring and having a significant impact.  Flowing out of the deal\, where elements of control are so important for minimizing and allocating risks\, arbitration is a logical extension of that planning\, presenting opportunities for both the parties and arbitrators to exercise control to make the process more effective – if they choose to do so. Relying on arbitration\, the parties can design a dispute resolution procedure that meets their needs.  Arbitration can be effective\, in particular\, for resolving commercial disputes involving technology and science (e.g.\, life sciences\, medical devices\, computer technology\, software\, and other technologies involving engineering). \nThe program will address some of the most innovative structures\, methods and techniques that can be used to re-think and refine arbitration as a dispute resolution alternative\, particularly for disputes involving science\, technology and IPRs.  The panel will discuss arbitration methods and techniques that are especially useful for technology-based arbitrations including choosing a panel with expertise; developing a procedural road map and timelines for the case; addressing confidentiality; options for taking expert testimony; defining technical terms and providing tutorials on science; managing discovery; phased approach / motion practice and interim awards to narrow issues and provide feedback to parties; other case management techniques to permit procedural flexibility and scope to exercise fair and practical control during arbitral process. \nDate & Time\nFriday\, April 16\n12:00 p.m. – 1:00 p.m. PDT\n3:00 p.m. -4:00 p.m. EDT \nSpeakers \n\nChristopher Gibson\, Moderator\nSuffolk University Law School\nBoston\, MA\nDeborah Coleman\nColeman Law LLC\nCleveland\, OH\nMichael Diamant\nTaft Stettinius &Hollister LLP\nCleveland\, OH\nHon.
