Each participant is assessed on his/her knowledge\, judgment and selfpresentation during discussion of a series of problems arising during a mock complex international arbitration and role play simulations. \n2. Written Assessment.\nWritten assignments will be part of the assessment process during the workshop portion of the program. One of the written assignments will be prepared in advance of the workshops and will be collected early on the first day of the workshops. \n3. Award Writing Examination\nThis element consists of a written\, open book examination in which an award must be written and fully reasoned based on the evidence in an arbitration proceeding. The exam is administered as part of this program. To receive a passing grade\, the award must meet international standards for enforcement. The exam administration and assessment fee is included in the tuition fee for the program.

DESCRIPTION:The ABA International Law Section is holding the third annual International Arbitration Skills Masterclass: a two-day hands-on virtual training program\, delivered by some of the world’s best international arbitration lawyers. \nThe Masterclass\, which is aimed primarily at junior to mid-level practitioners\, will comprise a mixture of panel discussions and practice sessions\, covering all aspects of an arbitral hearing (opening statements\, examination of witnesses\, examination of experts\, and closing statements). \nWorld-leading international arbitration practitioners and arbitrators will share their experiences and advice on how to deliver powerful oral submissions and effectively examine witnesses. SUMMARY:Foley Hoag United Nations Lecture Series Part IV: The Treaty of the High Seas:  What is it and what does it mean for States and Private Actors?
DESCRIPTION:On 4 March 2023\, after almost 20 years of negotiations\, United Nations Member States announced the finalized text of a historic agreement: a legally binding instrument under the United Nations Convention on the Law of the Sea on the conservation and sustainable use of marine biological diversity in areas beyond national jurisdiction\, known as the Biodiversity Beyond National Jurisdiction Agreement (“BBNJ” or “Agreement”)\, also referred to as the Treaty of the High Seas. \nThe high seas cover about 50 percent of the Earth’s surface; their health is key to the biodiversity and wellbeing of our planet. Until now\, a weak patchwork of international and regional legal regimes has governed activities including fishing\, deep-sea mining\, and shipping\, leaving these crucial ecosystems vulnerable to overfishing and the damaging effects of climate change. \nThe adoption and implementation of the BBNJ Agreement marks a critical step towards filling these gaps in international environmental governance by creating a framework that preserves the oceans’ status as part of the “common heritage of humankind.” The Agreement seeks to responsibly balance competing interests in the high seas by protecting marine biodiversity while \nadvancing opportunities for scientific discovery and promoting sustainable development. While the text of the Agreement is considered final\, it will come into force only once sixty States have ratified it. \nStates and private companies alike now wonder: How will this new framework under international law impact their interests\, rights\, and obligations?
