SUMMARY:Foley Hoag United Nations Lecture Series Part IV: The Treaty of the High Seas:  What is it and what does it mean for States and Private Actors?
DESCRIPTION:On 4 March 2023\, after almost 20 years of negotiations\, United Nations Member States announced the finalized text of a historic agreement: a legally binding instrument under the United Nations Convention on the Law of the Sea on the conservation and sustainable use of marine biological diversity in areas beyond national jurisdiction\, known as the Biodiversity Beyond National Jurisdiction Agreement (“BBNJ” or “Agreement”)\, also referred to as the Treaty of the High Seas. \nThe high seas cover about 50 percent of the Earth’s surface; their health is key to the biodiversity and wellbeing of our planet. Until now\, a weak patchwork of international and regional legal regimes has governed activities including fishing\, deep-sea mining\, and shipping\, leaving these crucial ecosystems vulnerable to overfishing and the damaging effects of climate change. \nThe adoption and implementation of the BBNJ Agreement marks a critical step towards filling these gaps in international environmental governance by creating a framework that preserves the oceans’ status as part of the “common heritage of humankind.” The Agreement seeks to responsibly balance competing interests in the high seas by protecting marine biodiversity while \nadvancing opportunities for scientific discovery and promoting sustainable development. While the text of the Agreement is considered final\, it will come into force only once sixty States have ratified it. \nStates and private companies alike now wonder: How will this new framework under international law impact their interests\, rights\, and obligations? SUMMARY:UC College of Law at San Francisco Speaker Series: The Enforcement of Metaverse-related Disputes Resolved in International Arbitration
DESCRIPTION:New technology brings opportunities and challenges for the resolution of disputes. The rapid development of\nvirtual reality technology offers users new immersive experiences\, with potential applications beginning with\nthe billion-member gaming industry but going far beyond it. Also utilising blockchain technologies\, such as\ncryptocurrencies and non-fungible tokens (NFTs)\, these metaverses bring potential new markets\, new types\nof property and new transactions. There have already been numerous examples of disputes involving digital\nassets\, which are key building blocks or elements of the metaverse. International arbitration may be a\ndispute resolution tool of choice for metaverse-related disputes of the future\, among other things due to the\nglobal enforceability of an arbitral award under the New York Convention on the Recognition and\nEnforcement of Foreign Arbitral Awards. \nThis presentation will describe some of the disputes likely to arise between users and platforms\, among\nmetaverse users\, and between users and non-users\, and highlight some of the challenges and solutions for\nenforcing metaverse-related decisions under the New York Convention. \nElizabeth Chan is a Registered Foreign Lawyer in Allen & Overy’s Asia-Pacific Arbitration Group based in Hong\nKong. She has acted as counsel or advisor in international commercial arbitrations/arbitration-related\nmatters and several investment treaty arbitrations (acting for both investors and States). In any case\, these efforts should mesh with the types of businesses and cultures involved. Perhaps the most obvious approach is to introduce a “standing neutral” (or “relationship facilitator”) into the relationship. Parties should use a standing neutral in any relationship that involves a significant investment or one of strategic importance. The neutral’s role is to ensure that the parties surface issues promptly\, have a forum for addressing them\, and resolve disputes efficiently. Dispute prevention agreements should include several important elements. First\, the parties should acknowledge the importance of maintaining a strong ongoing relationship and that open channels of communication are critical to success. Ongoing communication needs to focus on how the collaboration is working and what circumstances must be addressed to avoid serious problems. The program will include  leading experts in the field and will be moderated by  the Committee co-chairs\, Paul Gupta and Debbie Reperowitz. This interactive training will engage participants through large and small group discussion\, exercises and role plays. \nThis training is for: \n\n Mediators and neutral evaluators serving on court rosters under 22 NYCRR § 146\, Part 146\, Rules of the Chief Administrative Judge (“Part 146”);\nArbitrators and special masters who serve in court-sponsored programs; and\nNeutrals who provide services as a part of the Community Dispute Resolution Center Program\, under Article 21-A of the New York State Judiciary Law.\n\nThe training will: \n\nProvide plain language definitions and specific examples of the terms being used.\nExplain current research on bias and anti-bias practices.\nProvide participants with an opportunity to reflect on their personal and professional experiences as they relate to the topic of bias.\nTeach concrete anti-bias skills or practices that can assist ADR neutrals prior to\, during and after an ADR session\, such as recognizing and managing their biases; working with parties whose experiences\, behaviors\, and ways of expressing themselves may be different from their own; and reflecting on and assessing the ADR session afterwards\, through a self evaluation tool\, debriefing with a co-neutral or ADR program staff\, or reviewing participant evaluations\, where applicable.\n\nThis training satisfies 2 hours of the 6 hours of the continuing education required every 2 years under Part 146.5\, for mediators and neutral evaluators serving on court rosters. \nThis training program also meets the definition of Diversity\, Inclusion and Elimination of Bias category under 22 NYCRR §1500.2(g) and CLE credits will be handled through NYSBA. \nThis training is approved under Part 146 of the Rules of the Chief Administrative Judge and the New York State Unified Court System’s Office of ADR Programs. \nPlease note: \n\nFinal placement on any court roster is at the discretion of the local Administrative Judge;\nParticipation in a course does not guarantee placement on a local court roster;\nSome courts may require additional training and experience beyond Part 146’s requirements;\nAcceptance on court rosters may depend on a court’s need for mediators at any given time and may include a particular court’s need for mediators with specific case-type training or experience.  \n\nN.
