SUMMARY:ABA 2023 International Arbitration Skills Masterclass
DESCRIPTION:The ABA International Law Section is holding the third annual International Arbitration Skills Masterclass: a two-day hands-on virtual training program\, delivered by some of the world’s best international arbitration lawyers. \nThe Masterclass\, which is aimed primarily at junior to mid-level practitioners\, will comprise a mixture of panel discussions and practice sessions\, covering all aspects of an arbitral hearing (opening statements\, examination of witnesses\, examination of experts\, and closing statements). \nWorld-leading international arbitration practitioners and arbitrators will share their experiences and advice on how to deliver powerful oral submissions and effectively examine witnesses. There will also be a session on top tips for making an impact in a hearing. \nAfter each panel discussion\, the participants will have an opportunity to develop their advocacy and witness-examination skills through practice sessions in groups of four participants. Each practice session will be supervised by an experienced faculty member\, who will provide participants with tailored feedback. \nFollowing the success of the 2021 and 2022 editions of the Masterclass\, the 2023 edition will include a mock arbitral hearing demonstration\, which will see two leading practitioners demonstrate a variety of strategies and techniques by cross-examining experienced experts. \nThe event will also provide an excellent networking opportunity\, including through a virtual networking event. The SVAMC is happy to serve as a Supporting Organization of the 2023 Masterclass. \nWhile the standard registration cost is USD 400\, the SVAMC is happy to share our discount code lowering the cost to USD 275 for our network. SUMMARY:Foley Hoag United Nations Lecture Series Part IV: The Treaty of the High Seas: What is it and what does it mean for States and Private Actors?
DESCRIPTION:On 4 March 2023\, after almost 20 years of negotiations\, United Nations Member States announced the finalized text of a historic agreement: a legally binding instrument under the United Nations Convention on the Law of the Sea on the conservation and sustainable use of marine biological diversity in areas beyond national jurisdiction\, known as the Biodiversity Beyond National Jurisdiction Agreement (“BBNJ” or “Agreement”)\, also referred to as the Treaty of the High Seas. \nThe high seas cover about 50 percent of the Earth’s surface; their health is key to the biodiversity and wellbeing of our planet. Until now\, a weak patchwork of international and regional legal regimes has governed activities including fishing\, deep-sea mining\, and shipping\, leaving these crucial ecosystems vulnerable to overfishing and the damaging effects of climate change. \nThe adoption and implementation of the BBNJ Agreement marks a critical step towards filling these gaps in international environmental governance by creating a framework that preserves the oceans’ status as part of the “common heritage of humankind.” The Agreement seeks to responsibly balance competing interests in the high seas by protecting marine biodiversity while \nadvancing opportunities for scientific discovery and promoting sustainable development. While the text of the Agreement is considered final\, it will come into force only once sixty States have ratified it. \nStates and private companies alike now wonder: How will this new framework under international law impact their interests\, rights\, and obligations? How will the BBNJ Agreement be enforced\, and how will it work in tandem with existing international laws and regional and international governing bodies? \nThis roundtable discussion will explore these issues\, considering the following questions: \n\nWhat is in the BBNJ Agreement and how does it differ from existing regimes governing activities in areas beyond national jurisdiction?\nWhat obligations and rights will States party to the Convention have under the BBNJ Agreement?\nHow will the Agreement impact private companies and commercial activities?\nHow will the BBNJ Agreement be implemented and enforced?\n\nSpeakers: \n\nIntroduction: Christina Hioureas\, Partner and Co-chair of the International Litigation and Arbitration Department and Chair of the United Nations Practice Group at Foley Hoag\nIntroduction: Les Schiefelbein\, Founding Member and Vice-Chair of Board of Directors\, Silicon Valley Arbitration and Mediation Center\nModerators: Nick Renzler\, Counsel and Erica Harrington\, Associate\, Foley Hoag\nThembile Joyini\, Acting Chief State Law Adviser (International Law)\, South African Foreign Ministry\nAmbassador Eden Charles\, Lecturer\, Faculty of Law\, University of the West Indies; former Chairman of the BBNJ Preparatory Committee\nTim Scott\, Senior Policy Advisor\, Environment\, Bureau for Policy and Programme Support\, UN Development Programme\nNeil Popović\, Frank C. SUMMARY:Should You Arbitrate Cross-Border IP Disputes? Problems It Solves and Pitfalls to Avoid
DESCRIPTION:When parties to cross-border agreements involving intellectual property have a dispute\, litigating in court can be a mess: multiple proceedings in different countries\, costly and time-wasting fights about jurisdiction and procedure\, judges (and juries) who lack relevant experience\, delays caused by busy court schedules\, further delays for lengthy appeals (sometimes followed by remands and subsequent appeals)\, and obstacles to enforcing court judgments in other countries. \nChoosing to arbitrate such disputes can work wonders: a single proceeding\, scheduling and procedures tailored to the dispute\, arbitrators chosen for relevant experience\, avoiding delays caused by court schedules or procedural disputes or appeals\, and ease of enforcing arbitral awards. But to achieve these advantages\, it’s essential to avoid common pitfalls that can make arbitration more costly\, complicated\, and time-consuming than expected. \nThis interactive live panel discussion will address the advantages arbitrating IP disputes can achieve and critical pitfalls to avoid.\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nPanelists will include: \n\nDavid H.
