DESCRIPTION:New technology brings opportunities and challenges for the resolution of disputes. The rapid development of\nvirtual reality technology offers users new immersive experiences\, with potential applications beginning with\nthe billion-member gaming industry but going far beyond it. Also utilising blockchain technologies\, such as\ncryptocurrencies and non-fungible tokens (NFTs)\, these metaverses bring potential new markets\, new types\nof property and new transactions. There have already been numerous examples of disputes involving digital\nassets\, which are key building blocks or elements of the metaverse. International arbitration may be a\ndispute resolution tool of choice for metaverse-related disputes of the future\, among other things due to the\nglobal enforceability of an arbitral award under the New York Convention on the Recognition and\nEnforcement of Foreign Arbitral Awards. \nThis presentation will describe some of the disputes likely to arise between users and platforms\, among\nmetaverse users\, and between users and non-users\, and highlight some of the challenges and solutions for\nenforcing metaverse-related decisions under the New York Convention. \nElizabeth Chan is a Registered Foreign Lawyer in Allen & Overy’s Asia-Pacific Arbitration Group based in Hong\nKong. Perhaps the most obvious approach is to introduce a “standing neutral” (or “relationship facilitator”) into the relationship. Parties should use a standing neutral in any relationship that involves a significant investment or one of strategic importance. The neutral’s role is to ensure that the parties surface issues promptly\, have a forum for addressing them\, and resolve disputes efficiently. Dispute prevention agreements should include several important elements. First\, the parties should acknowledge the importance of maintaining a strong ongoing relationship and that open channels of communication are critical to success. Ongoing communication needs to focus on how the collaboration is working and what circumstances must be addressed to avoid serious problems. SUMMARY:Special Wellness Program:  Lessons for Lawyers from the Science of Well Being
DESCRIPTION:SVAMC is committed to supporting the wellness of its membership! The objective of this presentation is to help lawyers apply cognitive science to improve their well-being. We will begin with a brief overview of a problem endemic in the legal profession: lawyers continue to struggle with depression\, anxiety\, suicide\, and substance abuse at alarming levels. Research has found that more than one in four lawyers experience depression\, and nearly one in five reported anxiety. Between 21 and 31 percent of lawyers\, and up to 40 percent of law students\, report drinking at a level consistent with an alcohol problem. For many\, recent events have compounded that reality\, with the COVID-19 pandemic\, continued nationwide reckoning with systemic racism and other disturbing geopolitical events further challenging our individual and collective well-being. \nWhile addressing this issue requires both individual and institutional action\, this presentation will focus on the practical steps that legal professionals can take to improve well-being\, drawing on recent research from cognitive science and beginning with the preface that happiness can be learned and applied. Specifically\, we will provide an evidence-based arsenal of practical tools that lawyers can apply in their own lives to improve their well-being.
