SUMMARY:UC College of Law at San Francisco Speaker Series: The Enforcement of Metaverse-related Disputes Resolved in International Arbitration
DESCRIPTION:New technology brings opportunities and challenges for the resolution of disputes. The rapid development of\nvirtual reality technology offers users new immersive experiences\, with potential applications beginning with\nthe billion-member gaming industry but going far beyond it. Also utilising blockchain technologies\, such as\ncryptocurrencies and non-fungible tokens (NFTs)\, these metaverses bring potential new markets\, new types\nof property and new transactions. There have already been numerous examples of disputes involving digital\nassets\, which are key building blocks or elements of the metaverse. International arbitration may be a\ndispute resolution tool of choice for metaverse-related disputes of the future\, among other things due to the\nglobal enforceability of an arbitral award under the New York Convention on the Recognition and\nEnforcement of Foreign Arbitral Awards. \nThis presentation will describe some of the disputes likely to arise between users and platforms\, among\nmetaverse users\, and between users and non-users\, and highlight some of the challenges and solutions for\nenforcing metaverse-related decisions under the New York Convention. \nElizabeth Chan is a Registered Foreign Lawyer in Allen & Overy’s Asia-Pacific Arbitration Group based in Hong\nKong. She has acted as counsel or advisor in international commercial arbitrations/arbitration-related\nmatters and several investment treaty arbitrations (acting for both investors and States). She has experience\nacting in arbitrations under major international arbitral rules\, including the HKIAC\, ICC\, LCIA\, ICDR\, ICSID and\nUNCITRAL Rules\, seated in different arbitral seats such as The Hague\, Singapore\, London\, Geneva\, Austria\,\nHawaii and Washington\, DC. Lizzie is ranked as a “Future Leader” in Who’s Who Legal – Arbitration 2022-2023\nand in Legal 500’s Private Practice Powerlist – Arbitration (United Kingdom) 2022. She hosted the first-ever\narbitration gathering in the metaverse in January 2022\, followed by a conference in the metaverse as part of\nParis Arbitration Week in March 2022\, and writes and speaks regularly on the intersection of law and\ntechnology \nFor more information on the event\, click here. SUMMARY:Critical Issues: Dispute Prevention\, Cyber Security And Bias
DESCRIPTION:The New York State Bar Association (NYSBA) will be presenting a virtual program on Feb. 6.  \nAgenda: \n1:00 p.m. to 2:00 p.m.: Dispute Prevention\nHow Dispute Prevention Initiatives Work: Parties can incorporate prevention in their projects in many different ways. In any case\, these efforts should mesh with the types of businesses and cultures involved. Perhaps the most obvious approach is to introduce a “standing neutral” (or “relationship facilitator”) into the relationship. Parties should use a standing neutral in any relationship that involves a significant investment or one of strategic importance. The neutral’s role is to ensure that the parties surface issues promptly\, have a forum for addressing them\, and resolve disputes efficiently. Dispute prevention agreements should include several important elements. First\, the parties should acknowledge the importance of maintaining a strong ongoing relationship and that open channels of communication are critical to success. Ongoing communication needs to focus on how the collaboration is working and what circumstances must be addressed to avoid serious problems. Speaker: Myrna Barakat Friedman\, Managing Director\, MB Corporate Advisory Partners. \n2:00 p.m. to 3:00 p.m.: Cybersecurity – The Threats\, The Issues\, The Solutions\nThe New Wave of Technology Disputes and Best Practices for resolving them: \nThis presentation is sponsored by the new DRS Technology Committee\, which was formed because disputes involving technology have become one of the largest – and fastest growing – categories of ADR proceedings. The program will include  leading experts in the field and will be moderated by  the Committee co-chairs\, Paul Gupta and Debbie Reperowitz. The presentation will cover new challenges from AI-driven and other cybersecurity attacks\, as well as the growing pains of the fintech ecosystem. The faculty will also discuss resolving technology disputes\, including techniques for separating reliable evidence from “junk science.” This program will satisfy the new requirement for one CLE credit hour in the new Cybersecurity\, Privacy and Data Protection category.\n\n3:00 p.m. to 5:00 p.m.: Anti-Bias Training \nBreakthrough ADR’s anti-bias training is designed to (i) increase awareness of bias and its impact\, (ii) provide ways to assist neutrals to manage their biases\, (iii)  reduce and/or mitigate the prospect that bias will affect outcomes; and (iv) promote inclusivity and cultural awareness in ADR services. This interactive training will engage participants through large and small group discussion\, exercises and role plays. \nThis training is for: \n\n Mediators and neutral evaluators serving on court rosters under 22 NYCRR § 146\, Part 146\, Rules of the Chief Administrative Judge (“Part 146”);\nArbitrators and special masters who serve in court-sponsored programs; and\nNeutrals who provide services as a part of the Community Dispute Resolution Center Program\, under Article 21-A of the New York State Judiciary Law.\n\nThe training will: \n\nProvide plain language definitions and specific examples of the terms being used.\nExplain current research on bias and anti-bias practices.\nProvide participants with an opportunity to reflect on their personal and professional experiences as they relate to the topic of bias.\nTeach concrete anti-bias skills or practices that can assist ADR neutrals prior to\, during and after an ADR session\, such as recognizing and managing their biases; working with parties whose experiences\, behaviors\, and ways of expressing themselves may be different from their own; and reflecting on and assessing the ADR session afterwards\, through a self evaluation tool\, debriefing with a co-neutral or ADR program staff\, or reviewing participant evaluations\, where applicable.\n\nThis training satisfies 2 hours of the 6 hours of the continuing education required every 2 years under Part 146.5\, for mediators and neutral evaluators serving on court rosters. \nThis training program also meets the definition of Diversity\, Inclusion and Elimination of Bias category under 22 NYCRR §1500.2(g) and CLE credits will be handled through NYSBA. \nThis training is approved under Part 146 of the Rules of the Chief Administrative Judge and the New York State Unified Court System’s Office of ADR Programs. \nPlease note: \n\nFinal placement on any court roster is at the discretion of the local Administrative Judge;\nParticipation in a course does not guarantee placement on a local court roster;\nSome courts may require additional training and experience beyond Part 146’s requirements;\nAcceptance on court rosters may depend on a court’s need for mediators at any given time and may include a particular court’s need for mediators with specific case-type training or experience.  \n\nN. SUMMARY:Special Wellness Program: Lessons for Lawyers from the Science of Well Being
DESCRIPTION:SVAMC is committed to supporting the wellness of its membership! The objective of this presentation is to help lawyers apply cognitive science to improve their well-being. We will begin with a brief overview of a problem endemic in the legal profession: lawyers continue to struggle with depression\, anxiety\, suicide\, and substance abuse at alarming levels. Research has found that more than one in four lawyers experience depression\, and nearly one in five reported anxiety. Between 21 and 31 percent of lawyers\, and up to 40 percent of law students\, report drinking at a level consistent with an alcohol problem. For many\, recent events have compounded that reality\, with the COVID-19 pandemic\, continued nationwide reckoning with systemic racism and other disturbing geopolitical events further challenging our individual and collective well-being. \nWhile addressing this issue requires both individual and institutional action\, this presentation will focus on the practical steps that legal professionals can take to improve well-being\, drawing on recent research from cognitive science and beginning with the preface that happiness can be learned and applied. Specifically\, we will provide an evidence-based arsenal of practical tools that lawyers can apply in their own lives to improve their well-being. This CLE draws heavily upon a publicly available course taught by Yale professor Dr. Laurie Santos on the Science of Well Being (https://www.coursera.org/learn/the-science-of-well-being). \nSpeakers \n\nEmma C. Ross\, J.D./M.D.:  Emma Ross is a partner at Goldman Ismail Tomaselli Brennan & Baum LLP. With degrees in both law and medicine\, Emma plays a key role in national science teams and trial teams. She represents leading corporations in nationwide high-stakes disputes.\nShayna S. Cook\, J.D.: Shayna Cook is a partner at Goldman Ismail Tomaselli Brennan & Baum LLP in Chicago. As a leading trial lawyer\, Shayna represents multinational clients in a variety of company-critical disputes.\n\nDate & Time \nDecember 8\, 2022\n9:00am Pacific\n10:00am Mountain\n11:00am Central\n12:00pm Eastern \nCLICK HERE TO REGISTER.

SUMMARY:Webinar: Voluntary Carbon Markets and International Dispute Resolution
DESCRIPTION:We are pleased to sponsor the Young Members Group of CIArb NAB webinar\, “Voluntary Carbon Markets and International Dispute Resolution”\, on Thursday July 14\, 2022 @ 12 p.m. EDT/9:00 a.m. PDT. \nThis webinar is a sequel to last year’s series on Climate Change\, Decarbonization\, and International Dispute Resolution\, which covered a range of climate-related issues including rules governing carbon markets under Article 6 of the Paris Agreement. \nModerated by Nicola Peart\, the panelists Paul Barker\, Matthew Cranford\, Luciana AquinoHagedorn\, and Jesse Mosier (see bios below) will discuss the evolution of voluntary carbon markets\, carbon finance\, and the relevance of international dispute resolution from inhouse\, private practice\, and investment advisory perspectives. \nThe webinar will focus on voluntary carbon markets\, in which businesses and financial institutions purchase carbon credits to neutralize (“offset”) their residual greenhouse gas emissions. Carbon credit-generating projects — from nature-based solutions such as forestry to climate tech solutions such as direct air capture — frequently involve complex cross-border legal issues. Globally\, demand for carbon credits is rapidly increasing as corporates and financial institutions make net zero pledges\, but there are serious questions over the precise role of carbon credits in achieving net zero\, as well as related concerns over market integrity and “greenwashing”. In the absence of detailed mandatory regulation\, voluntary initiatives such as the Integrity Council for Voluntary Carbon Markets (ICVCM) are seeking to establish principles governing the supply of high-quality carbon credits. \nPanelists and Moderator Bios: \nPaul Barker is a partner at Kirkland & Ellis LLP\, based in San Francisco. SUMMARY:Tech Arbitration Trends: SVAMC Joint Event With Hogan Lovells
DESCRIPTION:We are delighted to invite you to join our upcoming panel discussion and networking drinks on Tuesday\, 12 July 2022.In a survey of 550 businesses released by Hogan Lovells in 2021\, 44% of respondents indicated that they had outsourced a key business function to a technology company in the last two years and half of those surveyed plan to outsource key business functions in the next two years.
