2023 California International Arbitration Week: The Future of California Arbitration and Best Practices for Drafting Technology Agreement Disputes Clauses and Structuring Investments

Silicon Valley Arbitration & Mediation Center and White & Case invite you to join us in Los Angeles for an interactive panel discussion on how to draft effective arbitration clauses for cross-border disputes, drafting innovations to be aware of and pitfalls to avoid, advantages of California as a forum, and how to structure investments to benefit from treaty protections.

Panelists:

Amb. (r.) David Huebner has handled more than 300 arbitrations in three dozen jurisdictions around the world.  He was based for extended periods in Tokyo, Shanghai, and New York, and now practices from Los Angeles.  He has particular expertise in the technology, life sciences, new energy, and media/entertainment sectors, and the Silicon Valley Arbitration & Mediation Center has regularly named him to its “Tech List” of the “world’s most accomplished technology neutrals.”   A graduate of Princeton University (summa cum laude) and Yale Law School, Amb. Huebner is a licensed solicitor in England & Wales, member of the Bars of California, New York, and DC, Fellow of the College of Commercial Arbitrators, Chartered Arbitrator and Fellow of the Chartered Institute of Arbitrators, and life member of the Council on Foreign Relations.  He is deputy chair of the Chartered Institute of Arbitrators’ global board of trustees and vice chair of the California Law Revision Commission.  He taught full semester courses in international arbitration, international business transactions, and intellectual property at USC law school for many years, and has guest lectured at other universities in China, Germany, New Zealand, and the U.S.  He spent 4 years in diplomatic service in New Zealand and Samoa and was appointed to the ICSID panel of arbitrators by President Obama.  See www.HuebnerArbitration.com for more information.

Barbara A. Reeves is a fulltime arbitrator, mediator and special master based in Los Angeles, California. She has more than 17 years experience arbitrating and mediating commercial disputes, with expertise in healthcare, intellectual property, antitrust, employment and entertainment. A graduate of Harvard Law School, she clerked for the Ninth Circuit (Judge Alfred T. Goodwin), was a trial attorney and section chief with the Department of Justice, Antitrust Division, a partner in major law firms (Morrison & Foerster, Fried Frank, Paul Hastings) and associate general counsel at a major electric utility holding company.

Brody Greenwald is a partner in White & Cases top-ranked international arbitration practice.  Brody represents companies and sovereign states in high-stakes international commercial and investment arbitration, mediation, and litigation. He practices before major arbitral institutions around the world in disputes over new technologies, mining, energy, infrastructure, telecommunications, banking, and cryptocurrencies.  Brody is recognized by publications such as Law360, Legal 500, Who’s Who Legal, and Lawdragon.  He practices in Los Angeles, is a founding member of California Arbitration, and is active on two of its committees.

Yasmine Lalou: A partner at the Chaffetz Lindsey boutique in New York, and fluent in English, French and Italian, Yasmine Lahlou has over 20 years of experience in international arbitration and litigation. Initially trained in Paris, admitted in New York and now splitting her life between New York and Los Angeles, Yasmine is experienced in civil and common law systems. Yasmine has represented clients in arbitration proceedings conducted under all the major rules and acted as a presiding, sole coarbitrator as well as emergency arbitrator in ICC, SCC, CRCICA (in Cairo) and LCIA arbitrations.

Moderator:

Sarah Reynolds is the Managing Partner of Goldman Ismail and the CEO of the Silicon Valley Arbitration and Mediation Center.  Sarah acts as an arbitrator and represents technology and pharmaceutical companies before domestic and international arbitral bodies. Sarah is a Fellow of the Chartered Institute of Arbitrators and is a Center for Conflict Resolution trained Mediator. She also serves on the Equal Representation in Arbitration Pledge North American and is a representative on the USCIB/ICC Arbitration Leadership Committee. Sarah is licensed in IL, CA and the UK.
