Mark C. Morril

Mark Morril is an independent arbitrator and mediator with experience in complex commercial disputes, including transactions, post-closing adjustments, technology, insurance coverage, distribution agreements, JVs, partnerships, IP, pharma, entertainment/media, telecom, energy, and aerospace. He is a member of the AAA-ICDR Large Complex Case panel, the ICC Commission on Arbitration, the ICC USA (USCIB) Nominations Commission, and the AAA-ICDR Council.

Previously, he was General Counsel of Simon & Schuster, then the world’s largest English-language publisher, and Deputy General Counsel of Paramount Global (ViacomCBS), with responsibilities for disputes, transactions, regulatory, compliance, risk management, and management of the 275-lawyer law department. Earlier, he was a law firm litigation partner and a judicial law clerk.

Mark is ranked in the Chambers Global Guide to International Arbitrators, described there as "an excellent chair [who] can ably take a complicated set of facts and reduce it to a readable and immune award ...a popular choice for commercial arbitrations", and in Chambers USA as bringing business experience that provides "an excellent perspective for commercial disputes." He is a Certified Mediator of the International Mediation Institute, described there as a "candidate of first resort" for "very impressive and high-end legal work - combined with a high level of economic and psychological as well as tactical know-how." Mark’s technology arbitration appointments include matters involving the licensing of digital imaging technology, financial processing software, the Computer Fraud and Abuse Act, the scope of a chipset manufacturer’s indemnification obligation, the licensing of patented medical devices, and life sciences disputes.

Mark has spoken and written extensively on cybersecurity, technology, and other dispute resolution related issues. He was co-author of "A Call to Cyberarms: The International Arbitrator's Duty to Avoid Digital Intrusion," 40 Fordham Int’l LJ 981 (2016) (with Stephanie Cohen), a member of the ICCA-NYC Bar-CPR Working Group on Cybersecurity in International Arbitration, which released the "Protocol on Cybersecurity in International Arbitration" (2022), and a member of the Working Group that authored the 2022 ICC Commission "Report on Leveraging Technology for Fair, Effective and Efficient International Arbitration Proceedings."
