Gary Benton is an internationally recognized Arbitrator with over thirty years major law firm and in-house experience in US and international business, corporate investment, technology, IP and emerging growth matters. Gary’s technology law career includes extensive experience litigating licensing and IP disputes, managing international legal projects for Fortune 500 technology companies, venture financing Silicon Valley tech startups, handling US and international M&A and IPOs, and serving as General Counsel of an Internet cloud security company serving US national security interests.
Gary is the founder of the Silicon Valley Arbitration & Mediation Center and serves on its Executive Committee and Board.
Prior to becoming a full time arbitrator, Gary was a partner for many years with the leading international law firms Pillsbury Winthrop Shaw Pittman LLP and Coudert Brothers LLP in San Francisco and Palo Alto.
In addition to his arbitration practice, he is on the Adjunct Faculty of the Santa Clara University School of Law and lectures on US and international arbitration law and practice.
Gary has handled hundreds of cases during his career. He has substantial experience as a single, presiding and panel arbitrator in U.S. and international arbitrations involving corporate, commercial and international business transactions, including private investment, private equity and venture capital, DeFi/FinTech, international business contracts, IT & Internet, telecom, life science & biotech, alternative energy, technology development, sales, marketing and distribution, competition, IP licensing and infringement (patent, trade secret and copyright), cybersecurity and A.I. disputes.
Gary is a Chartered Arbitrator and Fellow of the Chartered Institute of Arbitrators (CIArb), a Fellow of the College of Commercial Arbitrators (CollArb), an Academy member of the National Academy of Distinguished Neutrals (NADN), and a member of the Institute for Transnational Arbitration (ITA) Advisory Board, the International Council for Commercial Arbitration (ICCA), the American Intellectual Property Law Assn (AIPLA) and various other US and international arbitration and legal associations. He is the founder and Past President of California Arbitration (CalArb.org), the Co-Chair of the California Lawyers Association International Arbitration and ADR Subcommittee, and was the Co-Chair of California's 1st International Arbitration Week. Gary was named by the National Law Journal as one of the 25 ADR Trendsetters and Visionaries in the US. He is also named in the IAM 300: The World’s Leading IP Strategists.
He is a member of the ICDR International Panel, the AAA Commercial Panel (Large & Complex Cases, IP, High Tech, Corporate Law, Communications & Telecom, Contract Law and General Business specialty panels) and Energy (Alternative Energy) Panel, the CPR Institute for Dispute Resolution Panel, the Singapore International Arbitration Centre (SIAC) Panel, the Hong Kong International Arbitration Centre (HKIAC) List and IP Panel, the KCAB International Panel, the World Intellectual Property Organization (WIPO) Panel, the Asia International Arbitration Centre Panel and the Shenzhen Court of International Arbitration (SCIA) Panel, and serves as an Arbitrator on matters before the International Chamber of Commerce (ICC) Court of Arbitration and has served as counsel on matters before various other European and Asian regional arbitral institutions, as well as in UNCITRAL proceedings. He is a GAR listed Arbitrator.
Gary is qualified as a US lawyer (CA, NY, DC) and an English solicitor. He is admitted to the US Supreme Court, the Federal Circuit Court of Appeals and other US federal courts and serves on the US District Court NDCA Early Neutral Evaluation (ENE) Panel.
Gary has handled matters in over 80 countries, throughout Asia (including extensive work in China and India), Europe, Israel, Australia, the US, Canada and Latin America. He serves as an Arbitrator throughout the US and internationally in administered and ad hoc proceedings and is available for both in-person and videoconference matters.
